Machinex Technologies Inc. announced it won a court victory against Green Machine Sales LLC, Whitney Point, N.Y., which brought a patent infringement case against Machinex in 2019. The suit alleged that Machinex’s Mach Hyspec optical sorter infringed on Green Machine’s patent for its Green Eye optical sorter.
In response to a request from Machinex, on Oct. 4, the U.S. Patent and Trademark Office issued a final written decision stating that all claims filed by Green Machine in U.S. Patent 9,950,346 were unpatentable. Green Machine has since filed in court stating it would not appeal the invalidation of its patent, and asked the court to dismiss the lawsuit.
Based in Plessisville, Quebec, Machinex designs and manufactures recycling sorting systems.
